Ocean Front and Off-Street Parking Ordinances

These proposed amendments are  a continuation of the code revisions begun last year.  Through earlier amendments, the Village Council addressed construction site standards, underground parking provisions and elements of the Oceanfront zoning district.  The proposed amendments continue our review of the Zoning Code and in particular the OF Oceanfront district.  In light of the growing trend of further state preemption of local laws, it is advisable to review our zoning code and make the necessary amendments to bring them up to current standards, address resiliency where needed and implement protections to the character of our community and the quality of life of our residents.

These ordinance amendments are necessary in part because of the brand new and wholly unique zoning environment the Live Local act creates or may create.  The law, as written, leaves much to interpretation and it is the Village’s standpoint that it is incumbent upon the residents and their elected officials to clarify and codify how the new zoning will impact areas outside of the projects themselves, ensuring zoning is harmonized as, best possible, from district to district and that Live Local is not opportunistically interpreted by developers in ways that compromise the master plan of the entire Village. Because of this, we are reclarifying zoning in our Ocean Front district as well as codifying our requirements and restrictions for parking structures throughout the Village.
